Kelsey K. Black, Esq.

Kelsey Black represents companies and individuals in complex commercial litigation and construction disputes. Additionally, she has significant experience and involvement in injury, death and catastrophic property damage cases, in which she primarily defends some of the country’s largest corporations.

Kelsey began law practice in Boston, Massachusetts in 2007 with a firm of highly regarded trial lawyers. She moved to South Florida in January 2010 and joined the trial practice for a large, international law firm. For most of her tenure at these two firms, Kelsey litigated complex commercial litigation and catastrophic injury and death cases throughout the east coast of the United States. In February 2013, Kelsey and her former partner started a new practice Black Law P.A. f/k/a Waterway Black P.A. that emphasizes results, responsiveness, and value, leveraged by technology.

Kelsey became of counsel for Jonathan P. Cohen P.A. on select matters in 2016. Black Law P.A. and Jonathan P. Cohen P.A.’s synergy and collaboration has mutually benefited both firms and their clients.

Experience / Practice Areas

Kelsey’s primary general practice areas have included commercial litigation, construction and surety work, transportation litigation, and product liability. Her significant specific practice area litigation experience includes the following:

  • Construction and Surety – construction defect, contractor negligence, Miller Act, Little Miller Act, indemnity actions, and payment and performance bond claims.
  • Commercial Litigation – wide variety of complex and simple business disputes and consumer claims, involving general contracts, account and asset sales and purchases, development agreements, purchase agreements, non-compete contracts, indemnification agreements, fraud, statutory deceptive trade practices claims, lemon law claims, and judgment enforcement.
  • Railroad and Transportation Litigation – Federal Employer’s Liability Act, highway-rail grade crossing accidents, railroad trespasser fatalities and injuries, pedestrian accidents, sidetrack agreements and railroad contract disputes, and whistle-blower claims.
  • Product Liability – Death, personal injury, and subrogation and property damage matters, including several class actions, arising out of claims relating to products’ design, on highway and marine engines, power generators, consumer products, and recreational equipment.

Personal Interests

Kelsey has a family of four with two young daughters. She is an avid scuba diver, and despite her somewhat dorky love of the law, she’d still prefer to talk you about diving or travel or her family. In past life that seems like eons ago, Kelsey was a scuba instructor in the Caribbean.
